Quizproof Terms of Service

These terms govern the use of the Quizproof Shopify app ("Quizproof", "the app") by a merchant ("you"). The app is provided by Quizproof Labs ("we", "us"). By installing or using Quizproof you accept these terms on behalf of your business. If you do not accept them, do not install the app, or uninstall it.

1. The service

Quizproof lets you build product-recommendation quizzes, place them on your Shopify storefront, collect opt-ins with consent, sync opted-in shoppers to Shopify and, if you connect it, Klaviyo, and see answers, funnel statistics and orders that follow a quiz. We may change, add or remove features; we will not remove a core feature you rely on without notice in the app.

2. Licence

While Quizproof is installed and these terms are in force, we grant you a non-exclusive, non-transferable, revocable licence to use the app for your Shopify store. You may not resell, sublicense, copy, reverse engineer or attempt to access the app's source code or other merchants' data, except as the law permits despite this restriction. We and our licensors keep all rights in the app, its templates and its documentation.

3. Your content

You keep all rights in your quizzes, product data, images and the answers your shoppers give. You grant us the rights needed to host, process and display that content to provide the app to you. Templates we provide are starting points: you are responsible for adapting their questions, results and wording to your products.

4. Plans, billing and limits

• Billing by Shopify. Paid plans are billed through Shopify, in US dollars, on your Shopify invoice, together with any applicable taxes. Shopify's terms govern payment. Current plans and prices are shown on the app's plan page and our App Store listing.
• Free plan. The Free plan includes 25 quiz completions per month and shows a small "Powered by Quizproof" link on your quizzes. Every plan has every feature; plans differ by the number of completions included each month.
• Trials. Plans that offer a free trial say so on the plan page. If you cancel during the trial, you are not charged for that plan.
• Completions and limits. A completion is a shopper reaching their results, counted once per quiz run on our server; previews and test links do not count, and known bots are refused. When usage reaches 80% and 100% of your plan, we notify you. Quizzes keep working up to 120% of your plan's completions; past that, new shoppers see a "quiz unavailable" message with a link to browse your products until the next monthly period or a plan change, while shoppers who already started can finish. We never charge for usage above your plan.
• Changes. You can change plans at any time from the plan page through Shopify. Upgrades take effect when Shopify confirms them; downgrades take effect at the end of the current billing cycle. If our billing systems cannot reach Shopify, we keep your last known plan: you are never downgraded because of our outage.
• Price changes. We will give you at least 30 days' notice of a price increase for your plan, in the app or by email.
• Refunds. Fees already charged are not refundable, except where the law requires it or where we choose to issue a refund or credit through Shopify.

5. Acceptable use

You will not use Quizproof to:

• break any law, including consumer protection, advertising, privacy, anti-spam and health-product laws;
• make false or misleading claims to shoppers, or present quiz results as medical, legal or financial advice;
• collect data the app is not designed for, such as payment card numbers, government ID numbers, passwords, or health or other special category data without a lawful basis and the shopper's explicit consent;
• target quizzes at children under 16 or knowingly collect their personal data;
• send spam, or add shoppers to marketing without the consent the opt-in records;
• interfere with the app or its infrastructure, probe it for vulnerabilities without our written permission, overload it on purpose, or work around plan limits or bot protection;
• access another merchant's data.

We may suspend the app for your store if your use breaches this section or threatens the security or availability of the service, and will tell you why.

6. Your responsibilities for shoppers and their data

• Consent and notices. You are responsible for your store's privacy policy and cookie banner telling shoppers about the quiz, the opt-in, Klaviyo (if connected) and analytics, and for the lawful basis for processing their data. The opt-in records the consent each shopper gives for each purpose; the marketing checkboxes are never pre-ticked or required, and you must not change that through custom code.
• Quiz content. You are responsible for your questions, answers, results, product rules and wording, including any claims about products, and for checking that a published quiz recommends what you intend. Quizproof recommends only products and rules you approve; it does not invent claims.
• Data requests. You are responsible for sending shoppers the exports Quizproof prepares for their data requests.
• Your accounts. You are responsible for your Shopify staff accounts and permissions and for your Klaviyo account, including what you do with data in it.

7. Data protection

Our Privacy Policy describes how we handle data about you and your staff. For shopper data, you are the controller and we are your processor under our Data Processing Addendum, which forms part of these terms.

8. No guaranteed outcomes

Quizproof is a tool. We do not promise any increase in conversion, average order value, revenue, opt-ins or any other business result, and any figures in our materials are examples, not commitments. Statistics in the app (for example revenue from attributed orders) are estimates based on the data available to the app, including only shoppers whose analytics consent allowed tracking.

9. Availability and support

We operate Quizproof ourselves, and we do not offer a service level agreement. We monitor the service and work to restore it quickly, but there may be maintenance windows and unplanned outages. If the app is unavailable, your storefront keeps working: quiz blocks and links show nothing or an "unavailable" state rather than breaking your theme. Support is by email at support@quizproof.app or through the app's support form; we aim to reply within one business day.

10. Third-party services

The app works with Shopify and, if you connect it, Klaviyo. Your use of them is governed by their own terms. We are not responsible for their availability or for changes they make that affect the app, but we will adapt the app where we reasonably can.

11. Warranty disclaimer

Except as expressly stated in these terms and to the extent the law allows, the app is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement.

12. Limitation of liability

To the extent the law allows: (a) neither party is liable for indirect, incidental, special or consequential damages, or for lost profits, revenue, goodwill or data, even if advised of their possibility; and (b) each party's total liability arising out of or relating to these terms in any 12-month period is limited to the greater of the fees you paid for the app in the 12 months before the event giving rise to the claim and 100 US dollars. These limits do not apply to liability for fraud, wilful misconduct, gross negligence, death or personal injury, or anything else that cannot be limited by law, nor to your payment obligations or your breach of section 5.

13. Indemnity

You will defend and indemnify us against third-party claims arising from your quiz content, your products, your use of the app in breach of these terms or of the law, or your processing of shopper data as controller.

14. Term, termination and uninstall

These terms apply from installation until you uninstall the app. You may uninstall at any time from your Shopify admin; Shopify ends billing for the app. We may end the service for your store with 30 days' notice, or at once if you materially breach these terms or if Shopify ends our ability to provide the app. On uninstall, our access to your store ends at once and your data is deleted as described in the Privacy Policy and the DPA (when Shopify asks, 48 hours after uninstall; a reinstall before then keeps your data). Sections 3, 7, 8 and 11 to 16 survive termination.

15. Governing law and disputes

These terms are governed by the laws of Portugal, excluding its conflict-of-laws rules. The courts of Lisbon, Portugal have exclusive jurisdiction, unless mandatory law gives you the right to sue elsewhere. We will first try to resolve any dispute informally by email.

16. General

• Changes. We may update these terms. We will post the new version on this page with a new effective date and, for a material change, tell you in the app or by email at least 30 days before it takes effect. Continuing to use the app after that is acceptance; if you do not accept, uninstall.
• Entire agreement. These terms, the DPA and the Privacy Policy are the entire agreement between us about the app.
• Assignment. You may not assign these terms without our consent. We may assign them to a successor of the business, with notice to you.
• Severability and waiver. If a provision is unenforceable, the rest remains in force. Not enforcing a right is not a waiver.
• Force majeure. Neither party is liable for delays or failures caused by events beyond its reasonable control.
• Notices. We send notices to the store owner's email address. Send notices to us at support@quizproof.app.
